Christian & Small Partner James (“Jim”) L. Pattillo obtained a complete summary judgment in the Northern District Court of Alabama on behalf of a national insurer. The claim involved the application of Kansas law and the internal stacking of underinsured motorist benefits. The plaintiff’s estate argued that it was entitled to stack the coverage on the decedent’s policy up to three times as provided by the Alabama Underinsured Motorist (“UIM”) statute. Pattillo argued, and the Court agreed, that the Alabama UIM statute did not override a Kansas insurance policy or Kansas law, neither of which allow for internal stacking of UIM benefits.
